COMMERCIAL TERMS
1. PERSONS TO WHOM THIS OFFER APPLIES
The goods included in the Company Arte-Mar web site henceforth ("the site"), are offered to final customers only. Retailers are excluded from this offer.
2. EUROPEAN AND NATIONAL LAW
Sales shall be made in accordance with the Distance Selling Directive 97/7/EC of 20 May 1997 on the protection of consumers in respect of distance contracts, the Spanish law "Ley de Ordenación del Comercio Minorista", of 15 January 1996, articles 38 to 48, and R.D. 1906/1999 of 17th December if that is the case.
3. ORDER ACCEPTANCE
3.1. Customers may order the goods described in the Site ("the goods"), according to the following:
- a) Select the goods clicking on the icon "Add to basket".
- b) Click on the icon "Make order" and follow the steps given from the sistem.
- c) Confirm the order clicking on the icon "Confirm order".
3.2. Orders will be accepted only if complying with the above.
4. ORDER CONFIRMATION
4.1. Placing an order, the customer accepts the present Conditions of Sale.
4.2. The Company Arte-Mar has the option of refusing orders.
5. PAYMENT TERMS
5.1. The goods purchased will be paid by PAYPAL, credit card or money order following the setps indicated for payment within the company web site and for particular terms of the order.
6. CURRENCY AND INVOICE
6.1. Payments shall be made in EUROS.
6.2. The Company Arte-Mar when dispatching the goods, will send the invoice to the address specified in the order confirmation.
7. PRICES AND TAXES
Price of goods are inclusive of V.A.T. (IVA) (when are applicable), but delivery charges are specified in the particular terms of the order.
8. DELIVERY CONDITIONS
8.1. Upon receipt of the total value amount of the order, goods will be given to transpor agency that they will deliver the goods to the customer.
8.2. The goods will be delivered to the address specified in the order confirmation, unless decided otherwise by the customer.
8.3. Arte-Mar will not assume responsibility of guarantees nor goods when transport agencies take parte, if they have not been contracted by Arte-Mar.
8.4. The seller Arte-Mar retains ownership of the goods supplied until payment in full has been confirmed.
9. RIGHT OF WITHDRAWL
The customer shall have a period of seven working days in which to withdraw from the contract, from the day of receipt of the goods by the customer.
10. TERMS FOR RETURNING GOODS
Pursuant to art. 44 of the "Ley 7/1996 de Ordenación del Comercio Minorista" and art. 4 of the R.D. 1906/1999, goods may be exchanged or refunded within 7 days of the date of receipt of the goods.
11. "FORCE MAJEURE".
The seller will have no liability whatsoever for any non-delivery or late delivery due to circumstances beyond seller´s control ("force majeure").
12. CUSTOMS DUTIES AND INCOTERMS
Customs duties will be charged to the customer´s account, unless the Incoterm agreed specifies otherwise.
13. APPLICABLE LAW
The sale of the goods for this offer shall be governed in accordance with the Laws of Spain.
14. PREVAILING LANGUAGE
General Conditions and Offer are prepared in Spanish which shall be the prevailing language, serving any other version as translation without haveing any legal effect.
15. SETTLEMENT OF DISPUTES
15.1. Art. 17 of the Directive 2000/31/EC of 8 June 2000 on electronic commerce, on out-of-court dispute settlement will be applicable.
15.2. All disputes arising in connection with the present general conditions and offer shall be finally settled by Arbitration, including if so appropriate electronic means on line.
15.3. The applicable Rules of arbitration will be the ones of the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules.

PAYMENTS
Could I receive and pay my order by cash on delivery?
Yes, you can. But, note that transport agencies charge 5% aprox. of the total amount of the order, moreover than the transport costs. So, we will have to charge this 5% to your order and moreover, you will have to pay in advance a 30% of the total amount of your order. If you want to use this method of payment, write a note about of this in observations field of the order form. Anyway, Arte-Mar saves oneself all rights to decide if any order is accepted or it is not.
Could I pay by credit card?
Actually we can offer the payment method by PAYPAL. This is a very confidence and secure payment method. By PAYPAL, if you have a PAYPAL account you can pay with it, or if you have not PAYPAL account o you do not want pay with it, you can pay with credit card (VISA, MASTERCARD, AMEX...).
Could I finance my order?
Actually, our legal department is working for determining the process to manage the online solicitudes of finance.
How do I the payment of the order?
Actually, we offer two methods of payment: Cheque/Bank transfer or PAYPAL.
The procedure to pay by cheque is: sending us a cheque to our address and made out to our name. If you choose bank transfer, write a note in observations field of the order. So we will send you by e-mail our bank information.
The procedure to pay by PAYPAL is: select it in payment section of order and follow the instructions of system and PAYPAL.
When we receive the payment, we will send your order to your address and conditions.
SHIPPING/RECEIVING ORDERS
Above all, you must know that all our products are shipped from our stores with best quality levels and perfect finished, after that they have passed several exhaustive quality controls.
Orders will be supplied, except stock breakage, between 48 and 72 hours (to the Spanish Iberian Peninsula), if the order have been issued before of 5 PM local hour of commercial hours. Orders issued after 12 AM hour of Friday will be managed in the next working day.
All our consignments are insured by the transport company, so if any of the consignments has any anomaly or irregularity you must note inmediatelly or befor of 24 hours in writting by fax or email to the transport company and to Arte-Mar, to we fill in the incidence form.
Procedure when you receive a order.
Usually, the reason of the items of purchase arrive defective to the customers, is caused of hits or bad treatment made by transport agency.
When the distributor delivers you the order, you must do the next check or test:
* The quantity of packages must be equal than the written in invoice. (1)
* Packages must not have any hit or deformation (2)
* All items must have their respective package. (3)
(1) – In case of the quantity of packages is not equal than the written in invoice, repel the order and write in invoice the reason of the return. The signature of the distributor is not necessary.
(2) – If some item or package have hits or deformation, unpack the items at sight of the distributor and write in the invoice the hits and deformations that packages had and all damages than the items have. The distributor must sign with you.
(3) – If some item has not its respective package, write this subject in invoice.
DELIVERINGS AND RETURNINGS
How my order will be deliver?
If you can be only in some certain hours, write it in observations of the order form. In other case, Arte-Mar or transport agency can call you to agree on a day and hour to the delivery.
Remember than you have 5 additional addresses, to the case of you do not want to send your order to your main address. So, if you want to send the order to another address (for example, sending a present to a friend), write the option that you want in respective step of ther order form.
We will send you a email telling you that your order has been sent from our stores and the days of delivery. We ask you for one person exist in address and to the hour that you wrote in order form. Transport agency can charge you a extra cost caused to second trial of delivery.

How do I a complaint?
Remember that you only have available 24 hours to complain about products with damages caused by transport.
You can complain by sending a e-mail to post-venta@artemar.es.
Remember that if the complaint is about a production defect, the product have 1 year guarantee as minimum. In order to you do your complaint, send us a email to post-venta@artemar.es and tell us your trouble.
Could I collect my order directly from the shop?
You can ask for collect your order directly from our stores. To this, write this observation in order and contact us to do the respective steps.
Could I reutrn the order if I do not like it after I have received the order?
Of course. You have 48 hours to use your rectify right. We suggest you to read our delivering and returning terms (Click here).
My money will be given back to me if I return the order?
All our customer, have the right of withdrawl during 7 days from the day of receipt of the goods by the customer.
Yes, your money will be given back to you. In case of returning, the products have to be in perfect conditions and with its original package. When we receive the goods in our stores, and we will check them. Then, we will return the amount by the method of payment of the order in 30 days maximum time.
In case of returning, asked by customers or clients, not caused of production defects, we will charge the following costs:
1. Shipping and delivery costs
2. Collecting costs
3. Repairing costs, if is necessary
4. Other costs caused of returnings
GUARANTEE AND QUALITY
What guarantee have the products of Arte-Mar?
Our products have passed a rigorous quality control. The products will be delivered with a invoice that will be of use as guarantee of any anomaly of purchased products, for 1 year.
Defects caused of bad use or manipulation, negligence of customer, hits or wrong installing not done by Arte-Mar service are not included in guarantee.
PLACING A ORDER OR PURCHASE
How can I buy in Artemar.es?
Picking articles
Firstly, you must choose the products that you wish to buy. To this, search for the item in search machine of the web or navigate by lateral categories menu and when you arrive to the category, do click to the product picture that you wish to buy. Then you will see the product file. Here, you will have to choose the options of the product and do click to the button "Add to the cart"
Then, you will see a virtual shopping cart that it will show the products that you have choosen.
If you want to continue buying, press the button "Continue Buying" and repit th previous stpes.
If you wish to remove some item form your virtual cart, mark the square box on the left (called "Delete") and press the button "Update cart".
Doing the order.
When you have choosed and picked every products that you want, press the button "Do the order" under the articles list.
Note: Is not necessary that you take any fact of the order, because after you confirm it, every information will be sent to your e-mail and moreover, the order will be able for your enquiry if you are logged in.
In this step, if you are not logged in still, the sistem will show you a new window or screen by which it will ask you for your identification. Here, you will have two options:
1. If you already are a registered user, you will have to write your e-mail and password.
2. If you are not a registerd user still, you will have to become a user by "Register" button. In this setp, the sistem will ask you for every necessary information that we will need to contact you.
Choose the delivery address.
When you are logged in, your information and your address will be shown. If you want that the order be sent to another address, here you can choose it. Transport and delivery costs will change according to the address and to the weight of the goods.
Choose the payment method.
Here, you will have to choose the method of payment that you want to use (Cheque/Bank transfer, PAYPAL,...).
Confirm the order.
This is the last step. The sistem will show you every information of your order (items, prices, quantities, taxes, transport costs, method of payment, etc.). You will have to check if all information are correct and if you are agree with the conditions, you will be able to confirm the order pressing the button "Confirm order".

Could I modify my order?
You can modify your order before you pay it. In order to you can modify it, tell us every changes by any way (fax, email, phone...).
To changes after payment, we would check each case.
Could I modify the address or fiscal information?
Before you confirm the order ,you can modify the delivery address or fiscal information they both must not to be equal necessarily.

Actually, our commercial and technical deparments are working for install this method of payment. Still now, we do not have payment by Credit Card.
ABOUT WEAPON REPLICAS
Are permited this weapons?
Every weapons that you can find in this shop are replica only for decoration. Having or using them to other aims is forbidden by Spanish Laws.
- In case of cutting weapons (swords, daggers, sabres, letter openers, etc.), the blades can not cut. Only letter openers can be used to open envelopes or for decoration. The rest of cutting weapons are only authorized for decoration.
- In case of fire arms (pistols, rifles, etc.) are only authorized for decoration. In order to avoid the using of this firearms replicas its cannon are obstructed, and other measures have been taken to avoid its use.
